Nebraska LB285 Flavor Ban


What's happening?

A few weeks ago, LB285 was introduced in the Nebraska state legislature. This bill, if enacted, would ban all flavored nicotine vape products except menthol and tobacco in Nebraska.

LB285 is still in the early stages of the legislative process, which means we have a chance to squash it before it even makes it to the floor! With your help, we can stop this bill and protect your access to the vape products you depend on!

I urge you to oppose LB285’s ban on flavored nicotine vapor products.


Studies have shown that prohibition does not work.

 

Flavor bans are not only unfair to adults who like to use flavored vapor products, but also the studies regarding youth vaping do not support eliminating flavors in vapor products. Just the opposite is true; if you eliminate flavor products, both adults and youth are more likely to seek out traditional nicotine products like cigarettes. This is what big tobacco wants to happen.


According to the most recent youth vaping survey, very few teens will use cigarettes more than once and/or for a frequent period. In fact, the overall teen-vaping rate dropped 2023 to 2024. Teens are moving beyond vapor products to nicotine pouches.


Additionally, the legislation will have sweeping negative effects on vape shops across the state. Many vape-related businesses would effectively die overnight, subsequently causing many Nebraskans to become unemployed.

 

The committee needs to vote against passing this legislation onto the floor and focus on the things that are of real need in Nebraska, like regulating and taxing these products responsibly so that adults who choose to use the products can do so.
