Is Delta 8 Legal?

Delta 8 is a naturally occurring cannabinoid found in the cannabis sativa plant.  The legally grown hemp plants from which Delta 8 is extracted have been selectively bred to reduce their Delta 9 THC levels to less than 0.3 percent by weight. Only these low THC plants are federally legal. The absence of Delta 9 THC, simply known as THC, is a requisite for federal legality. THC is the psychoactive ingredient in cannabis.

Agricultural hemp plants may lack the well-known psychoactive component of cannabis but were initially in demand because they contain the popular cannabidiol (CBD) but Delta 8 is just one of hundreds of cannabinoids found in these plants. Delta 8 is one of these cannabinoids.

Ninth Court Legal Decision on Delta 8

Despite being manufactured from USA grown hemp, Delta 8 has had a target on its back. It is manufactured from the same CBD that is legal on store shelves almost everywhere. But critics of cannabis products in general have taken a dim view of Delta 8’s proliferation, falsely lumping it in with synthetic products.

 

Where is Delta 8 Legal?

Delta 8 is currently barred for sale in 13 states. Politically, it is a mixed bag that includes Alaska, Colorado, Delaware, Idaho, Iowa, Montana, New York, Nevada, North Dakota, Rhode Island, Vermont, Utah, and Washington. Several of these states might seem surprising, specifically Colorado.

But upon closer inspection, the decriminalization of cannabis and THC in Colorado plays a significant role in the state’s bottom line. This includes tourism, sales and of course taxes.

The barring of Delta 8 is of course shortsighted and flies in the face of the principals that led to decriminalization in the first place. It is a move that denies adults access to a naturally occurring product that is derived from legal hemp and is generally viewed as being milder than traditional THC-9.

This page will be routinely updated with information regarding states where the status of Delta 8 changes. But the issue has been settled on the federal level, unless legislators decide to make it a priority.

Whilst it would seem they have much bigger political fish to fry, anyone who has followed the twists and turns surrounding electronic nicotine delivery systems should be aware that many elected politicians and bureaucrats have few scruples when it comes to denying adults access to legal substances. This is specifically true when those impacted are not the ones making the rules.

 

What is Delta 8?

A recent study published by the University of Buffalo described Delta 8 as the “nicer younger sibling” of Delta 9 THC. Working in conjunction with researchers at the University of Michigan, this was the largest study yet on Delta 8. 

The combined efforts of these research teams published two papers based on their survey of more than 500 participants’ experiences with delta-8-THC and how it compared to cannabis. The words of one user best describe the overarching views shared by survey participants: that delta-8-THC is like delta-9’s “nicer younger sibling” because it provides all the benefits with fewer adverse reactions.

 

Largest Delta-8-THC Study

The recently published paper in the Journal of Cannabis Research was co-authored by Jessica Kruger, PhD, a clinical assistant professor of community health and health behavior at the University of Buffalo’s School of Public Health and Health Professions. It was co-authored by the University of Michigan’s Daniel J. Krueger.

According to Jessica Kruger: 

“Because this is one of the first studies of its kind on delta-8-THC and so many states have changed their legislation, we wanted to really explore what people felt as they were using it compared to delta-9-THC. We found that people who are utilizing delta-8-THC feel fewer negative side effects, and they are using it in modalities that are safer, like vaping or edibles or using topically.”

 

Research into Delta 8 is relatively new, and the Krugers’ work comes as more states are legalizing cannabis for recreational and medicinal use, while prohibiting Delta 8. Of the states that have banned delta-8-THC, six allow recreational use of cannabis, 10 allow medical use and three have decriminalized recreational use.

“It’s paradoxical that different states and municipalities are opening up to delta-9, it’s becoming more available and increasingly legalized, and yet they’re putting the brakes on delta-8, even though it seems to have a better profile in terms of its effects. It’s almost like the opposite of what you would do if you were informed of the evidence." This was the opinion of Daniel J. Krueger, University of Michigan co-author. 

Even with the reputation as a milder product, first time and experienced users should still take care and monitor their intake. Delta 8 is a product for adults. It should be stored securely where children and pets cannot access it.
